1. Who we are
Token Board is published by Pixby Media AB, a company registered in Sweden. You can reach us at hello@pixby.se.
In these Terms, "we", "us" and "our" mean Pixby Media AB. "You" and "your" mean the person or organisation using the App.
2. What Token Board is, and what it is not
Token Board helps adults create and run visual token boards, First–Then boards and step routines for routines, learning, transitions and reward-based support.
Token Board is a practical support tool. It is not a medical, diagnostic, treatment or emergency product, it does not provide medical, psychological, educational or behavioural advice, and it is not a substitute for professional judgment or for care from a qualified professional. Nothing in the App should be relied on to make a clinical or safeguarding decision. If someone is at risk, contact your local emergency services.
3. Eligibility and adult use
You must be at least 18 years old, or the age of majority where you live, to accept these Terms and to purchase anything in the App.
Token Board is designed to be set up and operated by adults — parents, carers, educators and support professionals. You are responsible for the boards, names, photos, rewards, notes and other content you add.
If you use Token Board in a professional, clinical or educational setting, you are responsible for your own legal obligations toward the people you support, including any consent, safeguarding, record-keeping and data protection duties that apply to you. We are not a party to that relationship.
4. Licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use Token Board on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
You may not:
- copy, redistribute, sell, rent, lease, sublicense or lend the App
- reverse engineer, decompile or disassemble the App, or attempt to derive its source code, except to the extent this restriction is prohibited by law
- remove or alter any copyright, trademark or other proprietary notice
- use the App in any unlawful way, or in any way these Terms prohibit
We reserve all rights not expressly granted to you.
5. Free features and Token Board Pro
The core board experience is free. Token Board Pro unlocks additional capacity and features, and is sold through the App Store as an in-app purchase.
Token Board Pro is offered as:
- a monthly auto-renewing subscription
- an annual auto-renewing subscription
- a lifetime one-time purchase, which does not renew
The exact features included in Pro are described in the App at the time of purchase. We may add to them over time.
5.1 Subscription terms
The following applies to the monthly and annual auto-renewing subscriptions:
- What it is: Token Board Pro, a subscription that unlocks the Pro features described in the App.
- Length: one month or one year, depending on the plan you choose.
- Price: shown in the App in your local currency before you confirm, and it may differ between App Store storefronts.
- Payment: charged to your Apple Account when you confirm the purchase.
- Automatic renewal: the subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
- Renewal charge: your Apple Account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you selected.
- Managing and cancelling: you can manage your subscription and turn off auto-renew in your Apple Account settings after purchase. Deleting the App does not cancel a subscription.
- No partial cancellation: cancelling stops future renewals. The current paid period is not cancelled and is not refunded on a pro-rata basis, except where the law requires otherwise.
5.2 Free trials
We may offer a free trial on a subscription. Where a trial is offered, its length and the price that follows it are shown in the App before you confirm.
A free trial converts into a paid subscription automatically unless you turn off auto-renew at least 24 hours before the trial ends. If you buy a subscription while a free trial is running, any unused portion of that trial is forfeited. Trials are generally limited to one per Apple Account per subscription group, as determined by Apple.
5.3 Lifetime purchase
The lifetime option is a one-time purchase. It does not renew and there is nothing to cancel.
A lifetime unlock covers the Pro features described at the time of purchase and any future features we choose to include in it. It does not guarantee access to separate future products, services, team or organisation plans, or to any successor application.
5.4 Prices and changes
Prices may change. A change to the price of an active auto-renewing subscription takes effect in line with Apple's rules, and where required you will be notified and given the opportunity to accept the new price or cancel before it applies.
We may change, add to or discontinue features, plans or the App itself. Where a change materially reduces what you paid for during a paid period, we will act reasonably and in line with your statutory rights.
5.5 Purchases and refunds
All purchases are processed by Apple, not by us. We never receive your card details.
Refunds for App Store purchases are handled by Apple under Apple's policies. We cannot issue, approve or guarantee a refund for an App Store purchase. If you believe you were charged in error, request a refund from Apple.
If you are a consumer in the EU or UK, you may have a statutory right to withdraw from a purchase. That right is administered by Apple as the seller, and nothing in these Terms removes it.
5.6 Restore purchases
If you reinstall the App or move to a new device, use Restore Purchases in the App to refresh your purchase status. Your purchase is tied to the Apple Account that made it.
6. Your content and your local data
You keep all rights in the content you create in Token Board. We claim no ownership over your boards, names, photos or notes, and we do not use them for any purpose — they stay on your device.
Because Token Board stores your data locally, you are responsible for backing up your device if you want to preserve it. Using Erase Local Data in Settings, deleting the App, resetting your device or losing your device will remove that data permanently. We cannot recover it for you, because we never had it.
7. Acceptable use
Token Board exists to support communication, predictable routines, dignity and positive reinforcement. You agree not to use it:
- in any unlawful, harmful, abusive, coercive or degrading way
- to withhold, or to threaten to withhold, anything a person needs — including food, water, the toilet, rest, medical care, communication, or contact with a parent or guardian
- as a punishment system, or in a way that a reasonable practitioner in your field would consider harmful or contrary to professional standards
- to interfere with, disrupt or attempt to gain unauthorised access to the App or any system related to it
- to resell, redistribute or commercially exploit the App or access to it
We may stop providing the App to you if you use it in breach of this section.
8. Third-party services
Token Board uses Apple for distribution and payments, and RevenueCat for purchase and subscription infrastructure. Your use of the App is also subject to the terms of those services, including the Apple Media Services Terms and Conditions. How those services handle information is described in our Privacy Policy.
9. Intellectual property
Token Board, its name, logo, mascot, designs, text, artwork and software are owned by Pixby Media AB or its licensors, and are protected by intellectual property laws. These Terms do not transfer any of those rights to you.
10. Disclaimer of warranties
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or that it will produce any particular outcome for any person.
If you are a consumer, this section does not affect your mandatory statutory rights, including your rights under EU, UK or Swedish consumer law, which apply regardless of anything in these Terms.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, loss of profits, loss of goodwill, or loss arising from your use of, or inability to use, the App.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the App or these Terms is limited to the greater of (a) the amount you paid us or Apple for the App in the twelve months before the event giving rise to the claim, or (b) EUR 50.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. If you are a consumer, your mandatory statutory rights are not affected.
12. Indemnity
If you use Token Board on behalf of an organisation, or in a professional or commercial capacity, you agree to indemnify and hold us harmless from any claim, liability, loss or expense (including reasonable legal fees) arising from your use of the App in breach of these Terms or in breach of any legal obligation you owe to a person you support.
This section does not apply to consumers using the App for personal or household purposes.
13. Termination
These Terms apply for as long as you use the App. You can end them at any time by deleting the App. Ending them does not entitle you to a refund of any amount already paid, except where the law or Apple's policies provide otherwise.
Sections 6, 9, 10, 11, 12 and 15 survive termination.
14. Changes to these Terms
We may update these Terms. When we do, we will change the "Last updated" date
above, and the current version will always be published at
https://gettokenboard.com/terms. Where a change is material, we will give
reasonable notice in the App or by other appropriate means. Continuing to use
the App after a change takes effect means you accept the updated Terms.
15. Apple-specific terms
These terms are required because Token Board is distributed through the App Store. In this section, "Apple" means Apple Inc. and its subsidiaries.
- Acknowledgement. These Terms are between you and Pixby Media AB only, and not with Apple. Pixby Media AB, not Apple, is solely responsible for Token Board and its content.
- Scope of licence. The licence granted in section 4 is limited to a non-transferable licence to use Token Board on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. Pixby Media AB is solely responsible for providing any maintenance and support for Token Board. Apple has no obligation whatsoever to furnish any maintenance or support services.
- Warranty. Pixby Media AB is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Token Board fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Token Board.
- Product claims. Pixby Media AB, not Apple, is responsible for addressing any claims relating to Token Board or your possession and use of it, including product liability claims, any claim that Token Board fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property rights. If a third party claims that Token Board or your possession and use of it infringes that third party's intellectual property rights, Pixby Media AB, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using Token Board.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right — and is deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.
- Contact. Questions, complaints and claims about Token Board should be directed to Pixby Media AB using the contact details in section 1.
16. Governing law and disputes
These Terms are governed by the laws of Sweden, without regard to conflict of law rules.
If you are a consumer, you also benefit from any mandatory provisions of the law of the country where you live, and nothing in this section deprives you of the protection those provisions give you. Consumers in the EU can also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
Subject to the above, the courts of Sweden have jurisdiction over any dispute arising out of these Terms.
17. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them as part of a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding Token Board.
